Tour Hub Pro Terms of Service

This Terms of Service Agreement (“Agreement”) constitutes a legally binding contract between Tour Hub Pro, a Delaware-based company (“Tour Hub Pro,” “we,” “us,” or “our”), and you (“User,” “Operator,” or “Customer”), governing your use of our all-in-one booking software and related services (the “Services”).
By accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to these terms, you are not permitted to use the Services.
1. The Tour Hub Pro Services
Tour Hub Pro is a software and technology platform that enables tour and watersport operators (“Operators”) to manage their business, including taking payments, organizing bookings, and maintaining customer and employee records. We are a booking engine and a software provider only.
Tour Hub Pro is not a party to any contract between an Operator and a Customer. We do not provide, organize, or manage tours or activities. We are not an agent of any Operator, nor are we responsible for the quality, safety, legality, or delivery of any tour or activity offered by an Operator.
2. User Accounts and Information
To create an account, you must provide certain personal and business information, including your full name, company name, email address, phone number, and banking details. You agree that all information you provide is accurate and current. You are responsible for maintaining the confidentiality of your account password and are liable for all activities that occur under your account.
3. Content and Intellectual Property
Operators are solely responsible for all content, including text, images, tour descriptions, and policies, that they upload to the platform. By uploading content, you represent and warrant that you own or have the necessary rights to use it and that it does not violate any third-party rights.
You retain all ownership of your content. Tour Hub Pro does not claim any rights to the content you provide. While we reserve the right to remove any content that is offensive, illegal, or violates these Terms, we have no obligation to monitor or police the content on the platform.
4. Payments, Cancellations, and Refunds
- Payment Processing: Tour Hub Pro facilitates payments through third-party payment processors. You acknowledge that all payment information is handled securely by these third parties.
- Pricing: Operators are solely responsible for setting and managing their own pricing. Tour Hub Pro does not interfere with the prices set by Operators.
- Cancellations and Refunds: Each Operator determines their own cancellation and refund policy. You, as a Customer, must contact the Operator directly to request a cancellation or refund. Tour Hub Pro is not responsible for handling these disputes or issuing refunds. The only exception is when a refund is legally mandated by a credit card company or other governing authority.
5. Limitation of Liability
Tour Hub Pro explicitly disclaims all liability for any direct, indirect, incidental, or consequential damages, including personal injury or property damage, arising from your use of the Services or any booking. This includes any issues related to the quality of a tour, an accident or injury that occurs during an activity, or any disputes between an Operator and a Customer.
By using the Services, you agree that you will not hold Tour Hub Pro responsible for any issues that arise from a booking or a tour.
6. Indemnification
You agree to indemnify, defend, and hold harmless Tour Hub Pro, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, or costs (including legal fees) arising from your breach of this Agreement, your use of the Services, or any content you upload.
7. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from this Agreement will first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute will be submitted to binding arbitration in Delaware.
8. General Provisions
- Entire Agreement: This Agreement, along with the Privacy Policy, constitutes the entire agreement between you and Tour Hub Pro.
- Severability: If any part of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any provision of this Agreement does not constitute a waiver of our right to do so in the future.
9. Amendments
We reserve the right to amend these Terms of Service at any time. Any changes will be posted on this page, and your continued use of the Services after such changes constitutes your acceptance of the new terms.
