Tour Hub Pro

Please read these terms carefully before using the Tour Hub Pro platform.

Welcome to Tour Hub Pro. These Terms and Conditions (“Terms”) govern your access to and use of the Tour Hub Pro software, websites located at tourhubpro.ai and tourhubpro.com, the application platform at app.tourhubpro.com, and all associated services (collectively, the “Service”). By creating an account or using the Service, you (“Client,” “Operator,” or “You”) agree to be bound by these Terms.

1. Description of Service

Tour Hub Pro provides a cloud-based booking, management, and payment processing platform designed specifically for tour operators, watersport businesses, and activity providers. We provide the software infrastructure to facilitate your bookings and transactions. Tour Hub Pro does not own, operate, or bear responsibility for the underlying tours, activities, or services you offer to your customers.

2. Account Registration and Security

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at info@tourhubpro.ai if you suspect any unauthorized access.

3. Fees, Payments, and Processing

3.1 Platform Fees. Use of Tour Hub Pro is subject to platform fees, commissions, and/or subscription charges as agreed upon during sign-up or within a separate written agreement.

3.2 Payment Processing. Tour Hub Pro utilizes third-party payment processors (such as Stripe) to handle transactions. By using our payment features, you agree to be bound by the applicable processor’s terms of service.

3.3 Payouts and Deductions. Tour Hub Pro collects funds on your behalf for transactions processed through the platform. We remit net payouts after deducting all applicable platform commissions, payment processing fees, and bank routing charges, as well as any fees incurred for supplementary features, usage overages, or add-on services. This includes, but is not limited to, exceeding allotted usage limits (such as CRM email caps) or opting into additional solutions like done-for-you marketing services.

3.4 Chargebacks and Disputes. You are solely responsible for all customer chargebacks, refunds, and payment disputes related to your services. Tour Hub Pro reserves the right to deduct chargeback amounts and associated dispute fees directly from your pending payouts or bill them to your account.

Important: Maintaining a high chargeback rate may result in account suspension. We strongly encourage clear cancellation policies and prompt customer communication to minimize disputes.

4. Client Responsibilities and Obligations

4.1 Service Provision. You are solely responsible for the safety, quality, and delivery of the tours, rentals, or activities you offer through the platform.

4.2 Customer Waivers. It is your responsibility to ensure your customers sign all necessary liability waivers and safety agreements. Tour Hub Pro provides software tools to collect these documents but makes no representations regarding their legal enforceability in your jurisdiction.

4.3 Compliance with Laws. You agree to operate your business in full compliance with all applicable local, national, and international laws, including obtaining all necessary permits, licenses, and insurance required for your specific industry and region.

5. Disclaimers and Limitation of Liability

5.1 Platform “As Is.” The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Tour Hub Pro disclaims all warranties, express or implied, including but not limited to uptime guarantees, merchantability, or fitness for a particular purpose.

5.2 Physical Liability. Under no circumstances shall Tour Hub Pro, its founders, employees, or affiliates be held liable for any personal injury, death, property damage, or other damages arising out of or related to the tours, watersports, or activities booked through our platform. Responsibility for the safety and conduct of all activities rests solely with the Operator.

5.3 CAP ON LIABILITY: IN NO EVENT SHALL TOUR HUB PRO’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS EXCEED THE TOTAL PLATFORM FEES PAID BY YOU TO TOUR HUB PRO IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

6. Intellectual Property

Tour Hub Pro retains all right, title, and interest in and to the Service, including all software, source code, logos, interface design, and intellectual property associated with tourhubpro.ai, tourhubpro.com, and app.tourhubpro.com. You may not copy, modify, distribute, sublicense, or reverse-engineer any part of the Service. You retain ownership of your own business data and content uploaded to the platform.

7. Termination and Suspension

Tour Hub Pro reserves the right to suspend or terminate your account at any time, with or without cause, including but not limited to instances of suspected fraud, excessive chargebacks, or a violation of these Terms. Upon termination, your right to access the Service will immediately cease. Where feasible, we will provide notice prior to suspension.

8. Text Messaging and WhatsApp Communications

Tour Hub Pro uses Twilio, a third-party communications platform, to deliver SMS text messages and WhatsApp messages to customers and operators as part of the Service. By providing your phone number and opting in to receive text messages through the Tour Hub Pro platform, you agree to the following terms regarding our messaging program.

8.1 Messaging Program Description. Tour Hub Pro sends transactional and service-related SMS and WhatsApp messages tied directly to core application functionality. These messages include, but are not limited to:

  • Booking and reservation confirmations
  • Payment receipts and Stripe Checkout session URLs
  • Reservation reminders and schedule change notifications
  • Cancellation notices
  • Check-in instructions and operational updates
  • Account-related notifications

These messages are necessary for you to complete and manage your reservation and payment flow. No marketing, promotional, or advertising content is sent through this messaging program unless you have separately and explicitly opted in to receive promotional messages.

8.2 Consent and Opt-In. By providing your phone number during the booking process on the Tour Hub Pro platform, you expressly consent to receive transactional SMS and/or WhatsApp messages from Tour Hub Pro related to your booking and account activity.

Consent is collected through the following method:

  • Web/Online Opt-In: During the booking checkout flow on app.tourhubpro.com, you are presented with a clear consent checkbox indicating that by providing your phone number, you agree to receive transactional text messages from Tour Hub Pro. The consent disclosure is displayed adjacent to the phone number field and includes the program name, message frequency, data rates notice, and links to these Terms and our Privacy Policy.

Your consent to receive text messages is not required as a condition of purchasing any goods or services. You may complete a booking without opting in to receive text messages.

8.3 Message Frequency. Message frequency varies based on your booking activity. Transactional messages are triggered by booking events (e.g., a new reservation, a payment confirmation, or a schedule change). You will not receive messages unrelated to an active booking or account action unless you have separately opted in.

8.4 Message and Data Rates. Standard message and data rates may apply depending on your mobile carrier and wireless plan. Tour Hub Pro is not responsible for any messaging or data charges imposed by your carrier.

8.5 Opt-Out. You may opt out of receiving text messages at any time by replying with any of the following standard opt-out keywords to the number from which you received the message:

STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPTOUT

Upon receiving your opt-out request, we will send you a single confirmation message to confirm that you have been unsubscribed. No further messages will be sent unless you re-subscribe.

For WhatsApp messages, you may also opt out by using the native “Block” feature within the WhatsApp application, or by contacting us at info@tourhubpro.com.

You may also opt out by emailing us at info@tourhubpro.com or by adjusting your communication preferences in your Tour Hub Pro account settings.

Please note that if you opt out of all text messages, you may miss important transactional notifications related to active bookings (such as schedule changes or payment confirmations).

8.6 Opt Back In. If you have previously opted out and wish to receive messages again, you may opt back in by:

  • Replying START, YES, or UNSTOP to our SMS number.
  • Re-enabling consent through your Tour Hub Pro account settings.
  • Contacting us at info@tourhubpro.com to request re-enrollment.

8.7 Help and Support. For help with our messaging program, reply HELP to any message you receive from us. You may also contact us at info@tourhubpro.com. When you text HELP, you will receive a response that includes our business name and contact information.

8.8 No Sharing of Opt-In Data. We will not sell, rent, or share your mobile phone number or any SMS/text message opt-in data with third parties or affiliates for their own marketing or promotional purposes. Information may only be shared with service providers (such as Twilio) who assist us in delivering messages on our behalf.

8.9 Carrier Disclaimer. Carriers (e.g., T-Mobile, AT&T, Verizon) are not liable for delayed or undelivered messages. Message delivery is subject to the effective transmission capabilities of your mobile carrier and network conditions.

8.10 Consent Records. We retain records of your messaging consent, including the date, time, method of opt-in, and the specific program you consented to, as required by applicable laws, the Telephone Consumer Protection Act (TCPA), and the Twilio Messaging Policy. These records are maintained for as long as required by local regulation or industry best practice.

9. Governing Law

These Terms and any dispute arising out of your use of Tour Hub Pro shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any unresolved disputes shall be settled by binding arbitration on an individual basis.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or within the platform dashboard. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.
